Roe did not legalize abortion. Rather the Supreme Nine ruled that the several state could not make abortion illegal. Abortion was legal in some states prior to Roe [4].
The legal position prior to Roe v. Wade was that abortion was illegal in 30 states and legal under certain circumstances in 20 states. In the late 1960s, a number of organizations were formed to mobilize opinion both against and for the legalization of abortion.
All the Supreme Court can legally do under the Constitution is to return the issue of abortion back to the several states.
