Title IX

The U.S. Department of Education’s Office for Civil Rights (OCR) enforces, among other statutes, Title IX of the Education Amendments of 1972. Title IX protects people from discrimination based on sex in education programs or activities that receive Federal financial assistance. Title IX states that:

No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.

Scope of Title IX

Title IX applies to institutions that receive federal financial assistance from ED, including state and local educational agencies. These agencies include approximately 16,500 local school districts, 7,000 postsecondary institutions, as well as charter schools, for-profit schools, libraries, and museums. Also included are vocational rehabilitation agencies and education agencies of 50 states, the District of Columbia, and territories and possessions of the United States.

Educational programs and activities that receive ED funds must operate in a nondiscriminatory manner. Some key issue areas in which recipients have Title IX obligations are: recruitment, admissions, and counseling; financial assistance; athletics; sex-based harassment; treatment of pregnant and parenting students; discipline; single-sex education; and employment. Also, a recipient may not retaliate against any person for opposing an unlawful educational practice or policy, or made charges, testified or participated in any complaint action under Title IX. For a recipient to retaliate in any way is considered a violation of Title IX. The ED Title IX regulations (Volume 34, Code of Federal Regulations, Part 106) provide additional information about the forms of discrimination prohibited by Title IX.

Bottom line, Title IX refers to sex.

For reasons utterly unknown to rational persons, the Obama regime took the position that student did not have use the restroom designated for their biological sex. The topic of transgender bathroom rights has been a hotly contested issue between states and the federal government since North Carolina passed a law last March that would require individuals only to use the bathrooms that matched their sex as assigned at birth. Though the Justice Department sued the state, there hasn’t been much progress since: Texas is talking about enacting similar restrictions, and a repeal of North Carolina’s legislation failed.

This week, the Trump administration made its first move away from expanding rights for transgender students. On Friday, the Justice Department filed a legal brief that withdrew its objections to an injunction that had blocked guidance from the Education Department, which required public schools to allow students to use bathrooms that corresponded with their current gender identity, according to the Washington Post. Last year, 12 states filed a lawsuit against the guidance, which the Obama administration responded was a violation of Title IX, a law that says that schools that receive federal funding cannot discriminate against a student’s sex or transgender status.

Perceived gender identity is not sex. Caitlyn may think of himself as a woman. That does not make him a woman. Likewise while Cass Bono may think she is a male, her chromosomes say otherwise.    Title IX prohibits discrimination based on sex, but Refinery29 claims that treating all men, or all women, the same is somehow prohibited discrimination based on sex.

Tell me on what planet is sex as assigned at birth?   So how does the act of emerging from the birth canal or your first breath in any way effect your biological sex?
